| Mid-Aug 1995 - Teri Ann is six years and three months old. Garry has had a very close relationship with his daughter Teri Ann, despite having to drive several hours on alternate weekends for visitation. Garry talks with Teri Ann nearly every day over the telephone. He has provided for her emotionally as well as financially. Garry informs Kathy that since Teri Ann is now old enough to travel and be away from her mother during his visitation, he intends to begin taking her to his home in Illinois for his allotted visitation from Saturday mornings through Sunday evenings. Kathy objects to this and demands to be present at all visitation. She forbids Garry to take their daughter to his home. Late-Aug 1995 - Garry tells Kathy that when he comes back from vacation to California to attend his sister’s wedding on August 26th, that he wants future visitations with his daughter to be without Kathy's presence. Kathy was very upset because she and Teri Ann were not invited to Garry's sister's August 26th wedding and Teri Ann was not asked to be the flower girl (this is mentioned in Dr. Rebesco's report). Kathy also refuses to agree to allow Teri Ann to have visitation at Garry's home. Sept 2, 1995 - Saturday, Garry's birthday. He drives into town for visitation. Garry, Kathy and Teri Ann go to Woodmar and then to Walgreen's together. This is where the first false charge of molestation will originate. They go back to Kathy's apartment so Teri Ann can prepare a birthday card for her father and dress-up for dinner. They then all go to dinner together to celebrate Garry's birthday with Kathy's parents. Garry stays in town overnight, goes to church on Sunday with Teri Ann and Kathy and then takes Teri Ann (alone) out to breakfast. He brings her home, plays for a while, then leaves for home in Northern Illinois. This will be the last day that Garry will get to be alone with his daughter for over 6 years...and counting. Sept 4, 1995 - Kathy tells Garry during a telephone conversation that she wants him to sign an agreement to limit all future visitations to three hours per month, under her supervision. She also wants him to agree that he will not have any overnight visitation or be allowed to take his daughter to his home in Northern Illinois. Kathy warns that if he refuses to sign this demand, she will pursue criminal charges against him for sexual molestation of their daughter in Walgreen's. Garry refuses and consequently Kathy denies him further visitiaton with this daughter. Early Oct, 1995 - Garry hires attorney R. Cordell Funk of Hammond, Indiana. Oct 16, 1995 - Garry's attorney files a court citation demanding his visitation rights be enforced in Magistrate Christina Miller's court. Miller instructs parties to agree on evaluator to determine validity of charges. Oct 17, 1995 - Court sets pre-trial conference for December 6, 1995, three months away. Nov 22, 1995 - Kathy files Petition for Continuance of pre-trial hearing set for December 6 and files for Termination of Garry's Visitation and Parental Rights because minor daughter was "sexually molested by father". Kathy also states, “Mother alleges that father has never once participated in the parenting of minor daughter” and that, “Daughter is extremely scared and afraid of father.” Kathy’s attorney is Wendell Goad, II. Magistrate Christina Miller grants continuance and re-set hearing to January 10, 1996. Dec 1995 - Kathy doesn't show for deposition. |
